By using the WSTR service from Web Site Traffic Report, Inc. (www.websitetrafficreport.com), you agree to these terms and conditions. These terms and conditions are subject to change without notice by posting the changes to our web site.

We or you may terminate your service at any time and without notice. You can terminate the service by removing our code from all items under your control.

You agree not to change the WSTR code. If this agreement is terminated by us or by you for any reason, you agree to remove our code from all items under your control

YOU USE OUR SERVICES AT YOUR OWN RISK. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE ARE NOT LIABLE FOR DAMAGES, DIRECT OR CONSEQUENTIAL, RESULTING FROM ANY FAILURE TO PROVIDE SERVICE, SUSPENSION OF SERVICE, OR TERMINATION OF SERVICE. WE DO NOT GUARANTEE THE AVAILABILITY OF THE WSTR SERVICES. YOU AGREE NOT TO HOLD US RESPONSIBLE FOR DATA LOSS OR INTERRUPTION OF SERVICE OF ANY KIND.

Websitetarfficreport.com retains ownership and all rights to the WSTR logos, patents, trademarks, trade secrets, software, databases, reports, and web sites.

We will not give your email address or personal identifying information to any third party without your permission or unless required by law or court order.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM YOUR VIOLATION OF THIS AGREEMENT OR ANY THIRD-PARTY'S RIGHTS, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF ANY COPYRIGHT, VIOLATION OF ANY PROPRIETARY RIGHT AND INVASION OF ANY PRIVACY RIGHTS. THIS OBLIGATION SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT. OUR LIABILITY WILL NOT EXCEED THE PURCHASE PRICE OF THE SERVICES.

We own the data on visitors to your web site that we collect, and we provide data to you as a service. You can use the data we provide for any legal purposes.

This Agreement will be construed and enforced in accordance with the laws of the State of Pennsylvania without regard to its conflict of laws or principles with laws and principles of any other jurisdiction. Venue for any dispute under this Agreement will be Bucks County, Pennsylvania.

Pages that crash browsers may be removed from our listings. You will not generate hits to your pages by any false or automated means including constant refreshing.

Your web site must not contain, or contain links to, content promoting the use of illegal substances; nudity, sex, pornography, or adult-oriented content; content promoting illegal activity, racism, hate, "spam," mail fraud, pyramid schemes, or investment opportunities or advice not permitted under law; content that is libelous, defamatory, contrary to public policy, or otherwise unlawful, or any other content deemed inappropriate by websitetarfficreport.com in its sole discretion.

If you are using our FREE service, you can not use any means, such as placing text or image close to the WSTR button, designed to dissuade a visitor from clicking on it.

For clients who have elected the paid option: You agree to pay us in accordance with our price schedule. Accounts are billed annually in advance. You may cancel your subscription at any time before the end of a billing period, and receive credit for the remaining period of the paid term at the prorata balance. Any part of the month will be considered a full month for billing purposes. We reserve the right to downgrade outstanding or terminated accounts to our ‘WSTR Free Service’, which is advertiser supported by paid ads which the service will run on websites where the service is installed. Any outstanding balance becomes immediately due and payable upon termination of this agreement for any reason.
